Understanding Washington’s Wrongful Death Laws (RCW 4.20)
Under Washington Revised Code (RCW 4.20.010), when the death of a person is caused by the wrongful act, neglect, or default of another person or corporation, the personal representative of the deceased person’s estate may maintain a legal action against the at-fault party for damages.
Our trial attorneys have represented families across Eastern Washington following fatal car crashes, semi-truck collisions, fatal pedestrian accidents, workplace disasters, and catastrophic negligence. We approach every case with deep respect, empathy, and uncompromising determination to hold wrongdoers accountable.
Who Is Entitled to Recover Damages in Washington?
Under Washington statutes, wrongful death actions are formally filed by the personal representative appointed by the probate court for the direct benefit of statutory beneficiaries:
- The surviving spouse or state-registered domestic partner of the deceased.
- The surviving biological children or stepchildren of the deceased.
- If the decedent leaves neither a spouse nor children, parents or siblings who meet statutory dependency requirements may recover damages under Washington law.
Recoverable Financial and Emotional Damages
Financial recovery in a Washington wrongful death action encompasses both economic losses suffered by the estate and non-economic losses sustained by surviving family members:
- Funeral, burial, cremation, and memorial service costs.
- Emergency medical and hospital expenses incurred prior to passing.
- Loss of the decedent’s expected lifetime financial earnings and benefits.
- Loss of companionship, love, care, guidance, and protection.
- Pain, physical suffering, and emotional trauma experienced by the decedent before death (under Washington Survival Action RCW 4.20.046).
